Pool Puncher Arrested Again

Police arrested four young adults early Sunday morning following an assault outside a North 7th Street restaurant. In an interesting twist, one of the alleged perpetrators was recently arrested, in a well-publicized case, for punching a police officer at McCarren Pool on July 2nd.

According to a spokesman for the 94th Precinct, around one in the morning on Sunday, August 5th an employee of Oasis stepped outside the restaurant to smoke a cigarette when he was approached by three males and one female. One of the young men asked for a cigarette. When the employee refused, the group began physically assaulting him. One of the perpetrators, Michael Nuñez, 17, grabbed a wooden plank from the ground and began beating the employee with the weapon.

After the perpetrators ceased assaulting the employee and left, police were called at 2:00AM. A thorough canvassing of the area, led to the arrests roughly ten minutes after the police arrived. The three young men, Nuñez, Rodolfo Torres, 20, John Rabsatt, 18, as well as the female, Diamond Mendez, 17, were booked and charged with Assault with Intent to Cause Physical Injury with a Weapon, a Class D felony, among other misdemeanor charges. All four were released on their own recognizance.

Employees and management at Oasis declined to comment on the assault.

Adding significance to this case is the fact that Torres was arrested last month for assaulting a police officer. In that incident, police were called to McCarren Pool on July 2nd after Torres and two friends refused to stop doing backflips into the pool. When the police approached them, Torres punched one of the officers in the face. Torres was also released on his own recognizance for that case.

Rabsatt and Mendez are scheduled to appear in court for their next hearing on Friday and are being represented by attorneys through Legal Aid. Torres and Nuñez have their next court date set on October 17th, and have been assigned private attorneys by the Court and Administrator’s office. Torres’ next court date for the McCarren Pool assault is on January 25th.

  1. Torres needs to be dealt with before he hurts someone badly. Are they waiting for him to assault someone else? What happened to three times your out. Meaning out of society and in jail!
